    摘要:

    《民法典》“物權篇”吸收了近年來農村土地制度改革成(chéng)果,重構了農村土地權利體系,爲承包地與宅基地“三權分置”改革不僅留下發(fā)展空間而且指明發(fā)展方向(xiàng)。本文通過(guò)對(duì)承包地與宅基地權利分置創新實踐演進(jìn)分析,揭示承包地與宅基地權利分置确權定位依據,從而提出進(jìn)一步促進(jìn)承包地與宅基地流轉取向(xiàng)。隻有進(jìn)一步依法賦予承包地與宅基地流轉權能(néng),才能(néng)有利于振興鄉村發(fā)展,實現城鄉社會(huì)共同富裕。

    Abstract:

    The "Real right chapter" of the Civil Code absorbs the achievements of the rural land system reform in recent years, reconstructs the rural land rights system, and not only leaves room for development but also points out the development direction for the reform of the "three rights separation" of contracted land and homestead. Through the analysis of the evolution of the innovation practice of the separation of contracted land and homestead rights, this paper reveals the basis of the determination of the right of the separation of contracted land and homestead rights, so as to put forward the orientation of further promoting the transfer of contracted land and homestead. Only by further conferring the transfer power of contracted land and homestead in accordance with the law can it be conducive to the revitalization of rural development and the common prosperity of urban and rural society.
